In Texas, strict window tint laws can make it challenging for people who are sensitive to sunlight or have medical conditions that require added protection. Without an exemption, drivers can only have up to 25% tint on the front two windows. Getting caught with illegal tint in Texas usually results in what’s called a “fix-it ticket.” While the court may waive the fine if you remove the tint, you’ll still have to pay for the removal itself and provide proof that it was corrected. One of the most common questions we hear is: “Is this legal?” The short answer is yes — Texas law specifically allows medical tint exemptions. Under Texas Transportation Code §547.613 (Window Tinting Exceptions), a motor vehicle may legally be equipped with darker window tint if the vehicle is used by a person with a medical condition that requires protection from direct sunlight. Proof of this condition comes in the form of a signed statement from a licensed physician or optometrist.
Since January 1, 2019, the Texas Department of Public Safety (DPS) no longer issues separate “exemption certificates.” Instead, the signed medical statement itself serves as the exemption. This means that with proper documentation, you are legally protected to drive with darker tint than normally permitted — offering you peace of mind, legal protection, and the health benefits of reduced UV exposure.
